Walk By Faith Fitness, LLC: TERMS OF USE AND POLICIES-

GENERAL STRUCTURE OF POLICIES, TERMS OF USE, DISCLAIMERS & STATEMENTS—

This website is operated by Walk By Faith Fitness, LLC (WBFF). Throughout the “Site” “site”, the terms “we”, “us” and “our” refer to WBFF and/or its associates. By visiting this website and/or purchasing any item, reading or taking in any posted materials from us, you willingly participating and engaging in our “community” “service” and 2“services,” and agree to be bound by the following Policies, Terms, and Conditions (“Terms of Service”, “Terms” “Policy” “Policies” “Terms and Policies” “Policies and Terms” “Beliefs” “Morals” “standards” “statement”), included, and by any policies referenced herein and/or available by hyperlink. Our Terms and Policies apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/or contributors of its content.

Please read these Policies and Terms carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you DO NOT agree to ALL the terms and conditions of this agreement, then you may not access the website or use any of our Services. If these Terms are considered an offer, acceptance is expressly limited to these Terms of Service.

SECTION 1: RETURN-REFUNDS AND/OR RETURN-EXCHANGES:-

If you desire to return a product you have purchased from WBFF online, you understand and agree to the following:

(1a) You must return the item within 14 calendar days from the date you received it.

(1b) Only items that have been purchased directly from WBFF online can be returned to WBFF for a return or exchange. Any WBFF product purchased through other retailers is currently prohibited and anyone involved is subject to prosecution.

(1c) If returning and/or exchanging, it is your responsibility to ensure that the item is repackaged with all attached tags, strings, accessories, stickers, coupons, and any other perk that was included with that item when the purchase was shipped to you. The package also needs to be returned as one whole unit (the same way it was shipped to you) within the 14 calendar days.

(1d) The item you are returning and/or exchanging must not be damaged by you, or cannot have been worn by you either.

(1e) Only outerwear (non-intimate apparel/items can be returned for exchanges such as: shirts, pants, jackets, etc. (no sports bras, jock straps, etc),

(1f) Some items purchased through special promotions may be final sale, and are not eligible for exchanges or returns (please refer to Section 14 for the terms of each offer).

(1g) WBFF reserves the right to make any final decision regarding a refund or exchange.

SECTION 2: RETURN-REFUNDS AND/OR RETURN-EXCHANGES: CONSUMER EXPERIENCES MADE EASY -

WBFF strives to provide an amazing shopping experience and superior customer service.

(1a) We encourage customers to carefully take measurements and know your sizes before any purchase.

(1b) You also have the option to consult with one of our Customer Service Representatives, if you have questions prior to purchasing or you can visit our FAQ page for information as well.

(1c) Unused items with original packaging as described in SECTION 1 are welcomed as needed. Exchanges are currently not available outside of the US, and orders can only be returned.

(1d) Some items purchased through special promotions may be final sale, and are not eligible for exchanges or returns (please refer to promotion disclaimers for the terms of each offer).

(1e)You will be assigned a unique code for any return-refund and/or return-exchange, to expedite the process and to create a smooth process for your experience.

(1f) A Customer Service Representative will be connected to your unique code to see your process through from beginning to end, and can help you return or exchange your item(s) and find the perfect replacement.

(1g) If you haven’t received your refund after 10 business days from the time your return was received at our warehouse, please let us know so we can further investigate the situation. Australia: Exchanges are not available in Australia, and orders can only be returned. Some items purchased through special promotions may be final sale, and therefore not eligible for exchanges or returns (please refer to Section 14 for the terms of each offer).

(1h) Please note, return-refunds are limited to three per customer per year.

SECTION 3: BILLING, ACCOUNT AND INVOICE INFORMATION -

WBFF reserves the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors. You understand that your content (not including credit card information), may be transferred unencrypted and involve:

(3a) transmissions over various networks; and

(3b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is encrypted during transfer over networks.

(3c) WBFF does not issue hidden fees, we itemize invoices and do our best to make sure fees are easy to read and understand

(3d) Some items purchased through special promotions may be final sale, and are not eligible for exchanges or returns (please refer to Section 14 for the terms of each offer).

SECTION 4: ORDERING, SHIPPING & HANDLING -

WBFF offers FREE US Shipping for orders over $200. When you make a purchase of an item from us, you will be assigned a unique order number and a package tracking code, which will be emailed to you so you are able to track your order until it arrives at the address you provide to us when making your purchase. WBFF uses the most cost effective shipping methods/rates possible. You agree to provide current, complete and accurate purchase and account information for all purchases made on our site. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed. We do our best to use the most efficient, cost-effective delivery methods/carriers. WBFF cannot guarantee third-party services; however, we will always investigate, correct, and address situations beyond our control as it relates to any shipping and handling issue. We typically process orders within 1-5 business days. Please allow additional time during sales and holidays. Shipping times will vary depending on where you live. We do not ship on Sundays or holidays. If your order requires that you pay for shipping, we are not able to refund or issue store credit for those shipping charges.

SECTION 5: ORDERING & USE OF SERVICES AND INFORMATION -

You represent that you are at least the age of majority in your state or province of residence, or that you have been given legal consent or allowed your minor dependents to use this site.

You may not use our products for any illegal or unauthorized purpose, nor may you use our products, services or information, in violation of any laws in your jurisdiction (including but not limited to copyright laws).

SECTION 6: ACCURACY & INFORMATION -

WBFF produces products, services and informational materials on this site to provide general information only, and should not be relied upon or used as the sole basis for making decisions without consulting any other appropriate resource as a primary, more accurate, more complete or more timely source of information.

This site contains personal experiences, shared experiences, multiple versions of the Holy Bible, and certain historical information and is provided for your reference only. WBFF reserves the right to modify the contents of this site at any time, and we have no obligation to update any information on our site. You agree that it is your responsibility to conduct the research you need to make decisions. Any reliance on the material on this site is at your own risk.

SECTION 7: WBFF RESERVES RIGHTS -

Our products are limited quantities and are subject to returns and/or exchanges only according to our return-refunds and return-exchanges Policies.

WBFF makes every effort to display accurate colors, descriptions and images of our products on our website. We cannot guarantee that the technology you use (phone, computer, tablet, or other device) will accurately translate over to your view.

We reserve the right, but are not obligated, to limit the sales of our products, services, or information to any person, company, organization, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products, services, or information that we offer. All descriptions of products or product pricing are subject to change at any time without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product, service, or information made on this site is void where prohibited.

In addition to other prohibitions as set forth under our Terms and Policies, you are prohibited from using the site, its content and any WBFF material, product, service, or information:

(8c) To violate any international, federal, or state regulations, rules, laws, or local ordinances;

(8d) To infringe upon or violate any intellectual property rights or the intellectual property rights of others;

(8e) To harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, gender expression, sexual orientation, religion, ethnicity, race, age, national origin, or disability; or any such civil right

(8f) To submit false or misleading information;

(8g) To upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation our business, service, information, or of any related functionality purposes;

(8h) To collect or track the personal information of others;

(8i) To spam, phish, pharm, pretext, spider, crawl, or scrape; or any such action;

(8j) For any obscene or immoral purpose;

(8k) To interfere with or circumvent the security features of our website, product, service or in/output of information, related to this business and organization.

(8l) WBFF reserves the right to terminate your use of our website and service violating any but not limited to mentioned these prohibited uses

TERMS OF USE -

SECTION 9: CONDITIONS-

The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms or Policies.

You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the our products, services, or information, or access any contact information on the website/social media platforms or other platforms through which we connect with customers, stores, ambassadors or associates, or any such without expressed written permission by us.

Prices for our products are subject to change without notice. WBFF reserves the right at any time to modify or discontinue any product, service, or information (or any part or content thereof) without notice at any time. We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of any product, service, or information.

We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors will be corrected.

A breach or violation of any of the Terms or Policies will result in an immediate termination of your purchase or our services provided to you and may result in an interception of delivery of any item to be returned to us, as determined by us.

SECTION 10: DISPUTE RESOLUTION -

Our customers’ satisfaction is of the utmost importance to us. We value every experience of every person, and/or purchase, no matter the case. Therefore, we will do all that is within our resource powers to make any situation satisfactory for each consumer or visitor of our site. In the event that a matter cannot first be resolved between WBFF and a consumer or visitor of our site, under the management of our customer services standards, and our Terms and Conditions; any and all disputes, issues and controversies, or matters arising herefrom, related hereto, or otherwise arising from or related to this site, these matters shall be governed by or construed exclusively in accordance with the laws and decisions of the State of Colorado without giving effect to its choice of law or conflict of law provisions. You agree that you are willingly engaging in the WBFF community or consuming any of our products from a Colorado based company, the State and federal courts sitting in Colorado overrule all other courts in other states and countries. Furthermore, by utilizing this site and as a consumer, you hereby consent to the jurisdiction of all applicable Colorado state and federal courts powers and authorities. And finally, as a consumer of this site you agree that you have read and understand all terms and conditions, and by continuing the use of this site and its products are making a sound a decision to not sue, hold liable, or bring forth any lawsuit against WBFF, its owners, board members, partners, consultants, employees, volunteers, or any of its associates. Therefore, you are agreeing to the Terms and Conditions and use, operations, and resolving any conflicts. If you should seek counsel and decide to move forward with any litigation actions, you agree to be liable for all WBFF’s legal fees as well. These Terms and Conditions are a relationship between you and WBFF.

You also acknowledge and understand that WBFF reserves the right with respect to any dispute arising out of or relating to your use of the Site may determine to have any dispute adjudicated through arbitration, if unable to first resolve the matter between you and WBFF, if we make this determination, it means:

(10a) YOU AGREE TO ARBITRATION

(10b) YOU AGREE TO HAVE ANY DISPUTED MATTER ADJUDICATED THROUGH BINDING ARBITRATION OR SMALL CLAIMS DISPUTE PROCEDURES, AND AGREE TO WAIVE YOUR RIGHTS TO PARTICIPATE IN A CLASS ACTION SUIT

(10c) YOU GIVE UP YOUR RIGHT TO HAVE A TRIAL BY JURY

(10d) YOU GIVE UP YOUR RIGHT TO SERVE AS A REPRESENTATIVE, AS A PRIVATE ATTORNEY GENERAL, OR IN ANY OTHER REPRESENTATIVE CAPACITY, OR TO PARTICIPATE AS A MEMBER OF A CLASS OF CLAIMANTS, IN ANY LAWSUIT INVOLVING ANY SUCH DISPUTE; AND

(10e) YOU MUST FILE ANY CLAIM WITHIN ONE (1) YEAR AFTER SUCH CLAIM AROSE OR IT IS FOREVER BARRED.

SECTION 11: CANCELLATIONS OR DELAYS-

If you need to cancel or revise an order, please contact our customer service department via the customer service email provided on the “contact us” page right away. We will do our best to accommodate your request, but we cannot guarantee revisions or cancellation after an order has been placed. WBFF orders cannot be cancelled or altered once submitted to our fulfillment team for processing. If an order needs to be cancelled on our behalf for any reason, we will contact you with the most recent email we have on file for you, as soon as possible. Unless the cancellation reason is associated with your actions as mentioned in Sections 8, and/or Section 9 of these Terms and Conditions. Should this be the case, WBFF would investigate and assess the matter, and follow its Policies as stated in Sections 7, Section 10, or elsewhere applied in these Terms.

SECTION 12: COOKIES & PRIVACY POLICY-

(12a) WBFF may use "cookies" to store certain information on your computer that allows us to give you the best possible online experience with us or to simply facilitate any signing in prompts. By continuing on this site you are consenting to our Cookies and Privacy Policy. Most browsers automatically accept cookies, but your browser settings can be adjusted to erase or block cookies or receive a warning before a cookie is stored. It will be your responsibility to refer to your browser instructions or assistance and to learn more about these functions.

WBFF may ask for some of your personal information, including your email address, name, mailing address, telephone number, or persistent identifier (such as a customer number held in a cookie). It is your responsibility to provide accurate personal information, so we can communicate with you effectively.

If you provide your personal mobile phone number to WBFF, you are agreeing and giving WBFF consent to send you text messages, by automated or other means. Standard messaging and data rates may apply. You will have the option to Reply “STOP” to opt out of text messages. It is your responsibility to inform us about any changes to your personal information. You have the option to update any of your personal information, by contacting us through the “Contact Us” page or our customer service email.

In addition to these Terms (e.g., IP addresses, cookies), WBFF may collect any of the following types of information that could constitute “personal information” under our Privacy Policy.

(12a1) Identifiers may include: names, signatures, aliases, postal addresses, telephone numbers, unique personal identifiers, online identifiers, Internet Protocol addresses, e-mail addresses, Social Security numbers, driver’s license numbers, credit card numbers, bank account numbers, debit card numbers, or other similar identifiers;

(12a2) Information protected against security breaches: names, Social Security numbers, driver’s license numbers, passport numbers, credit card numbers, bank account numbers, debit card numbers;

(12a3) May include: Protected legal characteristics: race, gender, religious beliefs;

(12a4) Commercial information: product shipment addresses, purchase histories;

Internet activity: information on customers’ interactions with the Services, interaction with social media sites maintained by WBFF;

(12a5) Inferences about personal preferences: use of or visits to the Services; product purchases and reviews;

If you decide to link to them through any of our online platforms, or services, or communication related, you agree and understand that we have no control over how such third party websites collect or use your personal information. We have no responsibility for any personal information you provide, consent to use, or post on such third party websites. We encourage you to read and understand the privacy policies of any third party websites that you visit.

(12d)CREDIT CARD PURCHASES-

WBFF may ask you to provide a credit card number in order to purchase a product. Credit card transactions are sometimes processed by a third party professional payment authorization service selected by WBFF to provide added security and reliability. Only the purchase price and the credit card information provided by you are supplied to this third party service. Information collected during credit card transactions is maintained in the service’s database for accounting and billing purposes and is not released to other third parties. WBFF does not maintain a copy of your credit card information on its servers and will not use your credit card information for any purpose other than processing your order.

(12e)PRIVACY RIGHTS FOR CALIFORNIA RESIDENTS AND ASSOCIATES

(18a) The failure of us to exercise or enforce any right or provision of any portion of our Return Policy, Exchange Policy, or Refund Policy, or any of the Terms of Service shall not constitute a waiver of such right or provision.

These Terms and Policies or operating rules posted by us on this site in its entirety are an agreement and understanding between you and us and govern your use of the site and any of our materials.

(18b) No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. All the above categories exclude text messaging originator opt in data and consent; this information will not be shared with any third parties.
